Maternity Pay for Term Time and Part Time Staff

Employees working term time only

One of our Regional officers has worked closely with a local authority on the complex calculations for maternity pay for Term Time and  Part Time Staff. These are the calculations that resulted from those discussions.

  

Holiday entitlement due following maternity: 

The following calculation addresses the maternity pay due for term-time/part-time staff.

Holiday entitlement due following maternity leave.

Your salary includes a holiday element. This is calculated as:

Full-time salary x part-time hours/full time hours x term time holiday fraction.

22,221 x 27.50/36.25 x 67/522 = 2,163.68 

To calculate the proportion of your holiday pay missing due to maternity pay the following calculation is done.

Annual holiday element / 52 x no of weeks at each level of maternity pay x percentage short.

Example

For your given approximate dates the following calculations would be done.

6 weeks 90% pay = 2163.68 x 6 x 10% = 124.83

12 weeks 50% pay = 2163.68 x 12 x 50% = 249.66

8 weeks 0% pay = 2163.68 x 8 x 100% = 332.87

Total = 707.36


 

Bank/Public holidays for administrative, clerical and technical staff working term-time only

Administrative, clerical and technical staff working term-time only are required to work for the 38 weeks (i.e. 190 days [38 x 5 = 190]) the school is open for pupils.

The employees are, however, entitled to be paid on a pro-rata basis for the Bank/Public holidays as they occur and proportionate leave based on the number of weeks they are required to work.

The full annual leave entitlement for employees with less than 5 years’ continuous service as at 1 January in any year is 23 days plus 2 statutory and for those with 5 or more years’ continuous service at 1 January in any year is 28 days plus 2 statutory days.

The 38 weeks plus the proportionate paid annual leave and bank/public holidays means that such employees with less than 5 years’ service will be paid for 435/522nds of the year while those with over 5 years’ service will be paid for 445/522nds of the year. The precise calculation is as follows:

The public/bank holidays are fixed but the remaining paid proportionate annual leave is for the employee to determine provided they are taken during periods of school closure.                             

The governing body of each school are able to decide on the number of weeks a year employees are required to work and many now require the school administrator to work for 39 weeks a year in order that they are on duty during the 5 ‘training days’.
